Read the details in leaked documents . -EU governments are negotiating on the basis of a highly dangerous mandate:+Exposing the “Fake Targeting” Trap -Indiscriminate chat control on a “voluntary” basis: The temporary law on Chat Control 1.0, which allows large US providers to scan our chats indiscriminately, in bulk, and without a court order, is to be made permanent without any changes. Private communications can not only be scanned for known illegal images and videos. Even unknown visual content, private chat texts and metadata can be classified by unreliable algorithms and AI as suspicious or not. Under the current voluntary “Chat Control 1.0” scanning scheme, German federal police (BKA) already warn that around 50% of all reports are criminally irrelevant, equating to tens of thousands of leaked legal chats per year.+EU governments are currently trying to replace the European Parliament’s demand for targeted warrants against specific suspects with a dangerous “compromise.” They want to allow authorities to issue broad “search plans” to scan “parts of a service.” In practice, this can still result in scanning every group chat or every user in the EU . This is mass surveillance by another name. -Experts are warning , too.+Even the Council’s own Legal Service has warned that this is likely illegal. In a leaked internal analysis (par. 47), they admitted that scanning entire service components is “highly probable” to be considered “general and indiscriminate” and would be struck down by the courts. Pushing this deal anyway is a betrayal of the rule of law and a false promise to victims, as the law would eventually collapse in court. -What is being discussed as a possible compromise would continue to allow American tech giants to screen the private messages of 450 million innocent Europeans en masse for known visuals without reasonable suspicion of any crime and without a warrant. Even when searching for “known” material (hash scanning), opaque international databases do not reflect European criminal law, and algorithms are blind to context and the lack of intent (e.g. motives of outrage, attempted humour, overestimating age, sexting by teenagers) . The result: According to former EU Commissioner Johansson 75% of all flagged chats (300.000 reported EU chats per year) are not actionable, drowning law enforcement in false positives and diverting resources from genuine investigations against producers and abusers. In its own implementation report (COM(2025)740 final), the European Commission admitted that there is no proven link between scanning private messages and actual convictions or children rescued.+The “Voluntary” Loophole (Chat Control 1.0) -Searching chats for already known images does not stop ongoing abuse, nor does it rescue children currently in danger!Perpetrators can easily migrate to other platforms where no scanning takes place.+There is a severe risk that negotiators could agree to a permanent Regulation 2.0 which allows the failed “Chat Control 1.0” (voluntary mass scanning) to be made permanent as a parallel loophole. This system is a proven disaster: German police data shows that over half of investigations target minors themselves for consensual sexting, while 75% of all flagged chats are not actionable . We cannot accept a deal unless this failed mass-scanning regime is fully terminated. -As we continue the fight against against chat control, we need to expand the resistance:+Take action -Explain to your friends why this is an important topic. Avoid Gmail, Facebook Messenger, outlook.com and X-Box, where indiscriminate chat control is already taking place.
